Venezuelan Environmentalists react disagreeing with Constituent Assembly called for by President Maduro

 

We, the undersigned Venezuela’s environmental, human rights organizations and professionals on the environment, express our deepest concern for the recent Decree Nº 2.830 / Official Gazette Nº 6295 where the National Executive calls for a National Constituent Assembly.

 

One of the reasons for a National Constituent Assembly, as cited in Decree Nº 2.830, is “The preservation of life on the planet, constitutionally developing with greater specificity the sovereign rights over the protection of our biodiversity and the development of an ecological culture in our society “.  However, according to Venezuela’s National Constitution (Article 347) the purpose of a Constituent Assembly is “… to transform the State, create a new legal system and draft a new Constitution”. Therefore, from Venezuelans environmental rights standpoint, it is fair to question ourselves whether it is the appropriate time to initiate a process for transforming the State’s foundations and structure as well as amending the environmental rights of the current Constitution, as stated by Decree Nº 2.830.

 

Venezuelan Constitution establishes (Article 127) that: “Everyone has the individual and collective right to enjoy a life and a safe, healthy and ecologically balanced environment”

This right is supplemented by two mandates to the State, which are: “The State will protect the environment, biological diversity, genetics, ecological processes, the national parks and natural monuments and other areas of special ecological importance”.

And: “It is a fundamental duty of the State, with the active participation of society, to guarantee for all people a pollution-free environment, where air, water, soil, coasts climate, the ozone layer and the living species are especially protected in accordance with the law “.

 

However, the Venezuelan State has not complied with the obligation of guaranteeing a better quality of life for Venezuelan people. An affirmation substantiated by the following facts:

 

1.   Venezuela is experiencing one of the most severe water rationing periods in its history, which cannot be explained by climatic factors alone. The rationing measure severely affects already vulnerable populations: in 2014, five million people lived in homes without direct water supply (ENCOVI, 2014) and a recent survey indicates that 69% of public hospitals’ beds throughout the country are non-functioning due to failure in water supply (National Survey of Hospitals 2016).

 

2.   Regarding the State’s responsibility in protecting the biological diversity, genetics and ecological processes: Venezuela has one of the highest deforestation rates in Latin America and, according to recent data, it is the only country in the Amazon region whose deforestation rate continues to increase (RAISG, 2015). This situation affects critical biological processes such as water collection, diversity conservation, soil protection and carbon sequestration, among others. In addition, the economic crisis has led to poor communities throughout the country resorting to intensive use of both fauna and flora to cover for their basic needs for food, shelter and income-generation.

 

3.   In addition, the National Parks and Natural Monuments system is in its worst state ever:  all protected-by-law natural areas located to the south of the Orinoco River show elevated levels of degradation from illegal gold mining, with the UNESCO natural heritage site “Canaima National Park” being emblematic of this situation. After numerous complaint reports, no actions have been taken to control the illegal activity. Similarly, protected-by-law natural areas located to the north of the Orinoco River, are seriously threatened by factors ranging from Government-supported housing initiatives to the uncontrolled expansion of the agricultural frontier.

 

4.   Moreover, living in a pollution-free environment is currently a utopia in Venezuela. A few examples: mercury pollution affects local indigenous and creole communities livelihoods in the Venezuelan Guayana; high pollution levels have been diagnosed in the Lake of Maracaibo due to both the oil industry and untreated sewage; unsafe drinking water is the only resource available to peoples of the central region; treatment of wastewater is practically non-existent; solid waste collection services are inexistent in poor urban areas; and illegal garbage landfills multiply all over the country.

 

5.   And even though climate change is considered the greatest risk to the environmental security of citizens, the national government is in violation of national legislations and international conventions by indefinitely delaying, and without explanation, the development of climate change mitigation and adaptation plans.

 

6.   Lastly, the “Arco Minero” (Mining Arc) of the Orinoco Project, which compounds the above considerations, seriously compromises the largest reservoir of water in Venezuela, ecosystems of high social and environmental value, and creates serious pollution risks not only in the intended project zone but in a much larger territory with the toxic substances used in mineral processing procedures. This goes without saying that the Project violates constitutional and human rights of indigenous and non-indigenous communities living in the area.

 

All factors above contribute to the general crisis underway in the country, and cause worsening of health, productivity and safety indicators, which altogether represent serious human rights violations. The common underpinning factor has been the inefficiency, ineffectiveness and disorderly fashion of Mr. Maduro’s Government.

 

We are convinced that Venezuela does not need a new Constitution, but compliance with the current one. A Government unable to fulfill its Constitutional mandate has no credibility, nor does it have the moral authority to propose a new Magna Carta.

 

We consider totally unnecessary, untimely and not in the best interest of our Nation to initiate a Constituent Assembly process. On the contrary, we demand the Executive to comply with and defend the current Constitution.

 

We are calling on Venezuelans to stand up in defense of our Constitution by actively exercising our rights participating in its defense.

 

We are calling on the international community, international conservation organizations and environmentalists throughout the world to support actions taken by Venezuelans in defense of our Constitution, which protects Venezuelans’ environmental rights and those of citizens of the world.
